Conditions

  • All prices quoted are net plus the applicable statutory VAT of currently 19%.
  • By signing the order, the client commissions GreenSign with the GreenSign Hotel certification. The subject of the certification is the sustainability performance of the business operated by the client. All contractual terms and conditions are set out in the following Terms and Conditions of Contract and in the General Terms and Conditions of GreenSign Institut GmbH attached to this contract, which can also be viewed at www.greensign.de/agb.
  • The certification cycle, which consists of a self-evaluation via a GreenSign online tool (hereinafter online tool), a preliminary certification assessment after self-evaluation, a subsequent audit and the certification itself, begins when the order is placed.
  • The client receives access to the online tool within 5 working days of placing the order for the purpose of self-evaluation. The client is guided through the certification process via the online tool. After completion of the self-evaluation by the client and transmission of the data collected through the self-evaluation, the client receives a preliminary certification result.
  • In order for the certificate to be issued, the self-evaluation must be reviewed by means of an audit. Provided that the license fee for the first year has been paid, GreenSign will carry out this audit within three months of completion of the self-evaluation process. The course of the audit and the associated obligations to cooperate are set out in the attached General Terms and Conditions.
  • The client or, if specified in the order, the company managed by the client receives a certificate of certification and a sign for display if it has fulfilled the certification requirements. The certificate awarded by GreenSign is protected by trademark law. The client has the right to use the certification in his business for indoor and outdoor advertising, on business stationery and for other advertising measures on his own account for 3 years from the start of the certification cycle against payment of the agreed annual license fees. The right to use the certification exists only for the assessed certification features and the assessed businesses and/or parts of businesses. At the end of the 3 years, this contract is automatically extended for a further 3 years if it is not terminated at least 6 months before the end of the respective term in text form. A new certification cycle begins with the extension as described above. The remuneration and license fees due for the new certification cycle are based on the price list published by GreenSign on the website at the time of the contract extension.
  • The license fee for the certificate to be issued for the first year is due upon transmission of the access data for the online tool and is invoiced with the first annual invoice. The license fee is due for payment within 14 days of the invoice being sent and is not dependent on whether and when the client carries out the self-evaluation. This also applies to subsequent license fees. GreenSign charges an audit fee for carrying out the audit. In addition, travel expenses incurred by the auditor for the performance of the audit (additional expenses for meals in accordance with applicable tax rates, accommodation and travel expenses). The choice of means of transportation is at the auditor's discretion. For rail travel, 1st class applies to all types of train. For journeys by private car, EUR 0.70 per kilometer driven will be charged. If the client cancels an agreed appointment, he is obliged to reimburse the travel costs already incurred and not reimbursable.
  • Should individual provisions of this contract be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, this shall not affect the validity of the remainder of the contract. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision. The above provisions shall apply accordingly in the event that the contract proves to be incomplete.
